TMD have extensive experience on working with both landlords and tenants for commercial and industrial premises, to name but a few.

Working with either or both parties on assessing liabilities, preparing and responding to Schedules of Dilapidations and negotiating a satisfactory settlement under the terms of the lease. Our team are able to provide a successful strategy to conclude all stakeholder negotiations.

Party wall & neighbourly matters

The Party Wall etc Act 1996 provides a framework for preventing and resolving disputes in relation to party walls, boundary walls and excavations near neighbouring buildings.

Frequently acting on behalf of Building Owners and Adjoining Owners, for both commercial and residential properties, TMD work with the relevant parties in protecting their rights and interests and advising them along the way in order to move their project forward swiftly.

Pre acquisition surveys

An important part of the due diligence process, pre-acquisition surveys help clients to make informed decisions before purchasing or investing in a property or portfolio of properties.

It can be an essential task, prior to investment or purchase, to gain critical information on the state and condition of a building, TMD can carry out surveys on a wide range of buildings; from multi-million pound property portfolios for pension funds to smaller scale surveys for one off commercial properties, for both tenants and landlords, including high end residential surveys. TMD will also advise the client on the necessity of appointing other specialist consultants where deemed necessary.

Building condition surveys

A building condition survey can be carried out in order to assess repair liabilities prior to acquisition or prior to entering into a leasehold agreement, TMD can also provide schedules of conditions for party wall matters. Surveys can also be used to gauge future maintenance requirements on a property, allowing forecasting for property repairs, similar to a PPM survey.

After a full visual inspection assessing the condition of the building our reports also look at specific repairs or advise on further specialist investigation where necessary.

Defects

Rather than carrying out a full building survey, our team of experienced chartered building surveyors are often asked to carry out a defect diagnosis on a specific problem within a client’s building. This could range from water ingress, mould growth, structural movement, timber decay etc. which could occur on a wide range of properties.

This type of survey can assist anyone from commercial and residential property owners, to facility managers and managing agents.

Dispute Resolution & Expert Reports

Building disputes can sometimes arise despite the best intentions between the parties. In these instances, the law offers Mediation, Adjudication, Arbitration or Litigation.

TMD can assist where required with many building disputes, often facilitating a resolution out of Court. We also have experience of being introduced by either party to a building dispute as an expert witness or by the Court as a Single Joint Expert. This involves the preparation of expert witness reports, litigation procedure and appearances in Court. We are qualified to assist where cases are before the Courts, Tribunals and Arbitrators.

Planned Preventative Maintenance (PPM) surveys are an essential tool that enable building owners and occupiers to proactively maintain, manage and improve their properties over a period of years.
